Courses Terms and Conditions for Totally Wild Food LTD

Please read these terms & conditions carefully before purchasing a place or buying a voucher to one of our courses. Once a completed booking has been accepted all the persons named on the booking form (“the client(s)”) will have entered a binding contract on the basis of these terms & conditions. AGREEMENT
Agreement on the basis these terms & conditions arise upon the fulfilment of all of a booking being made.

Totally Wild Food LTD reserves the right, in its absolute discretion and without the need to give reasons, to refuse to accept a booking. In such circumstances, no agreement arises and Totally Wild Food LTD will return any payment accompanying the booking.

The agreement is between Totally Wild Food LTD and the client(s) and is the sole agreement between those parties.

No variation of these terms & conditions shall be applicable unless agreed in writing by Totally Wild Food LTD before the relevant course. The person booking shall be deemed to sign that form for his / herself and as agent for all other persons listed on that form and warrants that he/she is appointed agent for that purpose.

The agreement is governed by English law.

2. PAYMENT

The balance of the fee as specified on the booking must be paid in full by the date specified on the booking, If not so paid, Totally Wild Food LTD reserves the right to treat the agreement as cancelled by the client(s) pursuant to clause 4, below.

If the payment of an invoiced course becomes overdue from the agreed payment terms Totally Wild Food LTD will charge the client £25 each and every week that the payment is overdue. This is to cover the admin costs that arise to chase this payment.

3. PRICES

Whilst every effort is made to limit prices to those given in the booking, Totally Wild Food LTD reserves the right to alter prices should its costs in hosting a course increase for reasons beyond its reasonable control (including, without limitation, the cost of labour, transport and materials). In the event that a price is altered the client(s) will be notified as soon as reasonably possible and the balance of the altered price will be payable on the same terms as was the original price. In the event of the price being thus increased by 10% or more the client may opt to cancel the booking and will then be entitled to a refund of all monies paid.

4. CANCELLATION BY CLIENT(S)

4.1 Place or places on a course will be secured when full payment has been received. Once a course is booked and paid for, any cancellation will result in a complete loss of all deposits and payment. Due to our courses requiring catering and being held on specific dates they do not fall under the 14-day consumer cancellation policy and we are not required to refund you. If you are unable to attend please see point 5 regarding rescheduling.

4.2 In the circumstance where a client is provided with credit for events (when a payment isn’t taken upfront) if clients cancel within 4 months of the course taking place they will be charged 100% of the original FULL course costs. This specifically relates to private events where deposits might be taken in advance and days of work being ringfenced specifically for the private event. 4.3 If Totally Wild Food LTD cancels a course, you’ll get a full refund for direct payments, but not for vouchers. Totally Wild Food LTD cannot refund if the cancellation is due to factors beyond our control, like extreme weather.

4.4 And the client acknowledges that it is reasonable for such penalties to arise, given the need for Totally Wild Food LTD to make preparations for a course substantially in advance of the course.

5. A REQUEST TO CHANGE THE COURSE DATE BY THE CLIENT

5.1 Totally Wild Food LTD understands that events arise that may be out of the control of the client, therefore, if the client wishes to change the date of the event they are currently booked on to, this can be done up to 30 days before the original course date. Totally Wild Food LTD will charge the client £10 to do this which must be paid in full before the date change can be fully processed. This payment helps cover the extra administration efforts required to make the changes and resell the original spaces where possible.

5.2 This cannot be done within 30 days of the event date.

6. VOUCHERS

By ordering a Voucher you also agree to the terms and conditions listed

Vouchers are non-refundable. The end date of the voucher may be extended, but this is at the discretion of Totally Wild Food LTD and will only be considered in extreme circumstances.

7. VARIATION OF A COURSE BY TOTALLY WILD FOOD LTD

A Totally Wild Food LTD course is, by its very nature, exposed to natural variables, including the weather.

Whilst every reasonable effort is made to deal with (indeed to learn from) such contingencies there may be occasions when, Totally Wild Food LTD through no fault of its own, is forced to vary or modify a course itinerary at short notice or decides to do so in order to take advantage of natural circumstances.

The client acknowledges that information about courses provided by Totally Wild Food LTD is given in the best of faith but that because of the variability of nature it may be reasonable to alter or modify a course and that in such circumstances it is not reasonable for Totally Wild Food LTD to be liable for any losses consequential on such a change and that Totally Wild Food LTD liability is limited accordingly.

8. THE CONDUCT OF A COURSE

The client acknowledges that during a Totally Wild Food LTD course he/she is required to submit to the reasonable instructions and leadership of the course leader. The client acknowledges that persons attending a Totally Wild Food LTD course are entitled to expect a high standard of conduct and regard for personal well-being on the part of all clients. For this reason, the client accepts that the course leader may, in its absolute discretion and without the need to give reasons, arrange for him/her to be removed from a course, if necessary against his/her will.

Circumstances in which this might occur include (without limitation) disorderly or abusive conduct; intoxication; inadequacy of clothing or equipment; incapacity or inability to meet the rigours of the course. In such circumstances, the client will not be entitled to a refund of monies and Totally Wild Food LTD will not be liable for any losses so resulting. The client will on demand reimburse Totally Wild Food LTD for its reasonable costs of effecting his/her removal.

9. LIABILITY

Totally Wild Food LTD courses take place in the open countryside and are by their very nature is not absolutely free from hazard. Totally Wild Food LTD makes every effort to minimise risk to clients and instructs clients in the safe negotiation of such risk as may remain. Consequently, the client acknowledges that there are circumstances in which an accident could befall a client without Totally Wild Food LTD being at fault and accepts that to that extent he/she is taking part in a Totally Wild Food LTD course at his/her own risk. Totally Wild Food LTD only accepts liability for physical injury to a client that is shown to result from obvious and complete negligence on the part of Totally Wild Food LTD. The client acknowledges that other loss, damage and expense (including, without limitation, loss of money, loss or damage to clothes and possessions, losses arising on the cancellation of a booking and the expenses of delay and harm caused other than by the negligence of) Totally Wild Food LTD howsoever arising is not the responsibility of Totally Wild Food LTD and that Totally Wild Food LTD liability is hereby limited.

During a course or event Totally Wild Food LTD act as wild food advisors, it is within the clients own choices as to whether or not they wish to eat the food provided to them, the client, therefore, takes liability for their own wellbeing. All foods discussed are either previously recorded as edible or have been eaten by the course leader, clients are in no way forced to eat anything.

Consumption of wild foods can potentially cause allergic reaction in certain individuals; we advise trying only small amounts of new wild foods on first consumption and there’s always the possibility of freak reaction which has no grounding or basis on the persons common bodily reactions to food Totally Wild Food LTD and its associated practitioners take no liability on these occasions.

Totally Wild Food LTD is not liable for guests consumption of any wild foods after an event has finished, this includes wild foods that are collected during an event and taken away by guests to consume separately to the event.

10. INSURANCE

Totally Wild Food LTD is insured as an Outdoor Activities provider & is covered to a level of £5,000,000 Public Liability Insurance. The client is also strongly advised to provide their own personal insurance cover, to include ‘Working with hand tools and eating wild foods’.

11. COMPLAINTS

In the unlikely event that a client has cause for complaint about a Totally Wild Food LTD course, a complaint should be made to a representative of Totally Wild Food LTD during the event, in order that corrective action can, if necessary, be taken. The client acknowledges that it is unreasonable to take no action during a course but to complain later. However, should a problem not be resolved, a complaint should be made in writing within 28 days emailed to info@totallywilduk.co.uk. To the extent permitted by law Totally Wild Food LTD will not be liable in respect of claims first intimated later than 28 days from the close of the relevant course.

12. SUBSEQUENT INSTRUCTION BY THE CLIENT(S)

Although all Totally Wild Food LTD courses are taught by highly experienced & capable leaders, it is not intended that any instruction provided to any client(s) while on a course will in any way qualify that/those client(s) to instruct any third party & no warranty is made to that effect. Totally Wild Food LTD hereby excludes any liability it might have to any third party in respect of any loss or damage suffered or incurred by that third party in its reliance on any skills taught by any client(s) on the basis of having attended any Totally Wild Food LTD course.

13. INSOLVENCY AND CANCELLATION BY TOTALLY WILD FOOD LTD

In the unlikely event that Totally Wild Food LTD becomes insolvent, where possible all monies will be refunded in full. In the event that Totally Wild Food LTD cancels a course, all monies will be refunded in full, or if preferred transferred as a deposit for another course of the same cost.

14. Sale of Age restricted items

As part of the transactional process, we will attempt to verify the age of the person purchasing any bladed product. We will seek to verify the customer’s details in order to clarify the customer’s age.

There are three possible outcomes when we perform our checks.

1. The customer’s age is verified, and they are believed as over the age of 18. In this case, the order will progress through our systems and be delivered as normal

2. The customer’s age cannot be verified and it is not possible to confirm whether they are over the age of 18 or not. In this case, DPD may require Photo ID on delivery

3. Unfortunately as the age verification was not successful the customer will be contacted by our Customer Services Team

“Please note under the Criminal Justice Act 1988 (as amended) we are only allowed to sell knives to persons aged 18 and over. Details of our age verification process can be found within our Sale of Age Restricted Goods Policy”.

15. ANIMALS ON EVENTS

Pets and animals are welcomed at most of our events, however we ask that owners understand that they attend at their own risk and at the owners liability. We cannot be held liable for any damage or injury caused by their pet or animal.

Owners must also ensure their pet or animal is kept under control and does not cause a nuisance to other attendees or damage to any property. We reserve the right to ask for a pet or animal be removed at any time during an event if it is deemed appropriate to do so.

16. USE OF OUT WEBSITE CHATBOT ‘DOUGIE Bot’

Please be aware that the chatbot found on our website and known as ‘Dougie Bot; is an automated system trained on our input data and customer handbook. It may not always provide 100% accurate information. While we strive to provide accurate information, we cannot guarantee the accuracy, completeness, or timeliness of the information provided by the chatbot and cannot be held accountable to information it provides.
